Overview

David is a nationally-recognized mediator and arbitrator, who has been a partner in global law firms, a federal prosecutor, and a general counsel of an investment bank. David has been recognized as a member of the National Academy of Distinguished Neutrals and of the New York Academy of Mediators and Arbitrators, and serves as a member of CPR’s Distinguished Neutrals Panels of Hedge Funds, Banking and Financial Services, General Counsel, and New York. He is a member of the mediation panels of the Federal District Court and Bankruptcy Court for the SDNY. He is a Fellow in the American College of Trial Lawyers and a Life Member of the American Law Institute.

As plaintiffs' counsel, he has successfully represented individuals and companies in breach of contract, breach of indenture, injunctive, and fraud cases in state, federal, and bankruptcy courts in New York, Delaware, California, Arizona, Texas, Georgia, Idaho, and Minnesota, and in the Courts of Appeals for the Second and Third Circuits.

As defendants' counsel, David has successfully defended securities class actions and derivative suits arising out of public offering and M&A litigation for investment banks, public companies and their officers, and independent directors, in many federal and state courts and arbitration tribunals around the country. He also obtained a judgment of acquittal in a criminal prosecution of a CEO for insider trading after two complete trials. In arbitrations before FINRA and predecessor tribunals, he has obtained successful verdicts on behalf of broker-dealers in claims brought by investors and employees.
